Terms and Conditions 

The following words or expressions shall have the meanings stated: 'The Photographer(s)' means Francesca McCarthy and/or a second shooter acting on behalf of Littles & Loves Photography.  “The clients” shall be those who have made the booking and have stated their name on the Booking Form.  

'Images' means all photographs, prints, images, albums and/or any other photographic product or other product comprising or containing reproduction of any form of photographic material, and which has been created by the Photographer. 

'Price' means the price as agreed at the time of the booking. 

 'Contract' means the agreed (wedding) package and timings between Photographer and Client of which these terms are an integral part. 

Agreement Overview 

This agreement contains the entire understanding between the photographer and the CLIENT (s). It includes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. 

Exclusive Photographer - The Photographer shall be the exclusive photographer retained by the Client for the purpose of photographing the wedding. Family and friends of the Client shall be permitted to photograph the wedding as long as they shall not interfere with the Photographer’s duties and do not photograph poses arranged by the Photographer. 

Wedding Booking Fee - The deposit of £300 secures the time and services for my services on your wedding date as well as acting as full acceptance of my terms and conditions. The deposit is non-refundable or transferable in the event of cancellation. Cancellation of a wedding booking less than 12 weeks before the booked wedding date will result in the full fee becoming due. All cancellations must be in writing to "Littles & Loves Photography" to my operating address at 12 Heather Drive, LS256PW. Weddings that are postponed to a later date will retain the fee as long as The Photographer(s) can reschedule for the new date and time.  

Wedding Payments - Following payment of the booking fee, the balance of fees due are to be paid three whole months prior to the wedding. Any additional expenses will also be due on this date. 

Special Requests/Coverage - The client understands and accepts that the photographic coverage will be as the photographer’s professional expertise determines and that not one photograph will be deemed more important than another. Special requests are not binding instructions, although every effort is made to comply with client’s wishes. There is no guarantee that any particular number of images will be produced. The client understands that the photographer must follow all rules given to them by the person/s facilitating the event and are not held liable for failure to deliver should the photographer be told that they are not allowed to take photos during the event or be stationed in one spot. It is the client’s responsibility to understand the rules ahead of time. 

Retouching - Editing will be to my signature style which is illustrated throughout my website and social media, I ask that no additional filters are added when uploading to social media. Any additional edits must be requested within 7 days of receiving the images. 

Licence - The Photographer(s) shall be granted complete artistic licence including in relation to the poses photographed and the locations used. The Photographers judgement regarding the locations / poses and number of images taken shall be deemed correct and final. Due to the weather and the willingness of subjects it may not be possible to capture all the images requested. The photographer is not responsible for missed images due to details not revealed to photographer. 

Model Release - The Client(s) grant the Photographers and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the images for social media, editorials, advertising and any other. If there is any reason why certain individuals cannot be shared on social media it is down to the couple to notify the photographer in advance of the wedding. 

Force Majeure - Every effort will be made to carry out the contract but its due performance is subject to alteration or cancellation by the Photographers owing to any cause beyond their control (eg acts of God, change in legislation, floods, fire, computer failure, etc). In the unlikely event of total photographic failure or cancellation of this contract by the Photographers, liability shall be limited to a full refund of all monies paid. 

Attendance - In the unlikely event of the assigned photographer(s) is/are unable to attend your photography session due to unforeseen circumstances, we reserve the right to appoint another photographer to attend on our behalf to undertake the photography to their best ability. 

Limitation of Liability - In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. 

Responsibilities - The Photographer is not responsible for existing backgrounds or lighting conditions which may negatively impact or restrict the photography coverage. Client agrees to confirm the schedule at least one-week prior to the event. Notification of any changes in schedule or location must be made in a timely manner. Changes can be made by phone or email with a follow-up email for documentation. If email is sent, confirmation of receipt must be obtained. 

Personal Accident - Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot. 

Delivery policy - A sneak preview will be sent to the client within one week of the wedding, wherever possible this will be sent within 48 hours. The remainder of the images will be sent between 8-12 weeks later. Whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence. The photographer retains the right to edit the photographs as she sees fit based on experience and expertise and omit any image(s) that do not meet her standards. 

Complaints - Any complaints should first be raised by the Client with Littles and Loves Photography in writing no later than 21 days from the date of receipt of images. 

Cancellation/Postponement - In the event of a cancellation by Client, the deposits paid are non-refundable. Should cancellation be received by the photographer/s less than 12 weeks prior to the date of the event then the full monies are none-refundable. The said sum shall be payable as compensation as an estimate of the loss the photographer/s would suffer. The deposit is none refundable at any stage past the point of booking 

Image Usage - All finally edited images from the session with the photographer will be provided to client. The images can be used by the photographer for their own promotional purposes (Instagram, Facebook, Twitter and Youtube, Tumblr, brochures, magazine articles, websites, sample albums and prints, venue and other vendor samples, and other such material, providing that the images used are used lawfully and without damage to the client(s). This list is not exhaustive), unless requested otherwise in writing by client which would then be added as a schedule to this contract. 

Harassment - Ensuring the appropriate behaviour of all guests and other persons at the event and other events covered by the Photographer shall be the responsibility of Client. In the event Photographer or his/her employee experiences any inappropriate, threatening, hostile or offensive behaviour from any guest or other person at the event or other event (including, but not limited to, unwelcome sexual advances and verbal or physical conduct of a sexual nature) then the following process shall be followed: first offense: a verbal warning will be issued; second offense: the offending person will be required to leave the event; third offense: the Photographer will end the event coverage immediately and leave the event, the Photographer shall be entitled to retain all monies paid hereunder and Client agrees to relieve and hold the Photographer harmless as a result of incomplete event photography coverage. 

Data Protection and Privacy - The Photographer will treat any information which is confidential to you and which we obtain as a result of providing the Services for you as strictly confidential save for the purpose of providing the Services or may as otherwise be agreed in writing. 

The Photographer will securely store your name and booking details contained within the Booking Form. These details will not be made available to any third party.  

We shall comply with the terms of any applicable data protection legislation in respect of the handling or processing of any personal data under or in connection with these Terms including, but not limited to the Data Protection Act 1998, the General Data Protection Regulation (EU Regulation 2016/679) and any other laws relating to the processing of personal data in force from time to time. 

Copyright - English Copyright Law declares that the copyright remains with the photographer. The photographer grants the client(s) permission to make copies of the images under the following conditions: The images taken by the photographer are for personal use by the client and their friends or family; selling the photographs is not allowed without permission from the photographer. 

Law - These Terms shall be governed by the Laws of England and Wales. 

Service Agreement - This confirms my contracting agreement: I agree that LITTLES & LOVES PHOTOGRAPHY shall provide services to photograph you to the best of our abilities in accordance with the package selected. Every effort will be made to ensure your satisfaction according to industry standards. Any artistic interpretation by the photographer will be deemed acceptable and correct. Due to the nature of the business, all sales are final. Although every care possible will be taken to produce photographs of all important and special moments during the session, the photographer cannot place an unconditional guarantee on the above.Notification of dissatisfaction must be received in writing within 21 days of receipt of images or upon receipt of products. The photographer will do all they can to ensure that you are satisfied with your images and products but cannot be responsible for dissatisfaction due to circumstances beyond their control.
